Gershman Mortgage is committed to protecting the privacy and security of the information you share with us. This Privacy Disclosure will help you understand how we use and safeguard information of our customers and former customers.



Information We Collect

We collect nonpublic personal information about you from the following sources: Information we receive from you on applications or other forms;
Information about your transactions with us, our affiliates, or others; and
Information we receive from a consumer reporting agency (commonly known as a credit bureau).



Information We Disclose

We do not disclose any nonpublic personal information about our customers or former customers to anyone, except as permitted by law. We do not sell customer lists to anyone. While we may share information about you with our affiliates (companies related to us by common ownership, control or with whom we have an Agreement), we will not share information obtained from an outside source or provided by you on applications with any other party unless we have first given you an opt out notice in accordance with the Fair Credit Reporting Act telling you how you may choose to restrict the sharing of information from outside sources with other parties.

We may disclose nonpublic personal information about you to the following types of third parties:

    •    Financial service providers, such as mortgage bankers or other purchasers of loans;
    •    Non-financial companies, such as investors that may purchase loans; and
    •    Others, such as non-profit organizations that may purchase loans.
We may also disclose nonpublic personal information about you to nonaffiliated third parties, including the following:
    •    To government, regulatory, and legal authorities in response to a subpoena, to prevent fraud, to comply with an inquiry by a government agency or regulator, or as necessary for other legal purposes;
    •    To third parties that perform services for us in the processing or servicing of your transaction, or that perform marketing or other services on our behalf;
    •    To third parties in connection with a proposed or actual securitization, secondary market sale (including sales of servicing rights), or similar transaction; and
    •    To third parties at your direction or with your consent, or as otherwise permitted by law.

Safeguarding Your Information
We restrict access to nonpublic personal information about you to those employees who need to know that information to provide products or services to you. We maintain physical, electronic, and procedural safeguards that comply with federal standards to guard your nonpublic personal information.

Accuracy of Your Information
We strive to keep our record accurate and will make appropriate corrections when you notify us. Please let us know if there is incorrect information in any statements or other communications that you receive from us.

Keeping Up-To-Date
We may modify our privacy practices occasionally. If we do so, we will communicate any material changes to you as required by law.
